The District is proposing to close a portion of Cemetery Road 818.8 meters squared in area. The District is proposing to sell the closed road to Hanna Raquel Corsan and Justin Davis Halldorson to be consolidated with their existing property at 11011 Hallam Drive. In exchange, the District will receive $35,000 for the land. 

The District will retain a Statutory Right-of-Way to allow public access to continue between Cemetery Rd and Hallam Dr.  The trail will remain accessible to the public. 

QUESTIONS & ANSWERS:

Why is the road being closed? 
The property owners asked if they could purchase the road from the District in order to increase their lot size. The increased lot size lets them build a second home on the land and keep their original home. Closing this section of road and adding it to their total land area makes this possible. None of the construction is allowed to be on the existing trail.

What happens to the trail? 
Nothing changes! Even though the road will be closed, as part of the road closure and sale of land, the District required the property owners to provide a legal right of way over the land guaranteeing the trail stays open and available to everyone. 

Can we still use the trail? 
Absolutely! Even though the road is being closed and sold to the property owners, nothing on the trail will change and it will still be accessible to the public. 

Can the property owners close they trail if they wanted to? What will the District do if that happens? 
No, they cannot close the trail because of the legal right of way on title. If that were to happen, the District has the legal rights to make sure the trails stays open for public use. 

Who owns the rest of the trail? 
This would be the only section of the trail the District has legal rights to. The rest of the trail crosses eight private properties, ending on Hallam Road. 

Is the District going to purchase the rest of the trail that is on the private properties? 
There are no current plans to purchase or put legal rights over the other private sections of land on the trail.
